It all began when the representative committee of the joint building at 23 HaRoeh St., Ramat Gan, approached our firm following a takeover of common property. The defendants, who had purchased a storage unit adjoining the building's laundry room, demolished a wall separating the storage unit from the laundry room, and turned the storage unit, together with the common area, into a residential unit, without the apartment owners' approval. These actions included extensive renovation, creating water and electricity infrastructure, altering the building's external appearance, and connecting to the building's central electrical infrastructure at the residents' expense.

The defendants, for their part, argued that they had purchased a right to use the laundry room and that they intended to lead the building into a TAMA (urban renewal) process. They raised complex defenses such as limitation, delay, estoppel, and waiver, arguing that the exclusive use of the area had continued for over 60 years, and that the plaintiff had delayed in filing its claim.

Our firm, representing the joint building's committee, managed the proceeding with great professionalism. We focused on proving the unlawful takeover of the common property and the breach of the joint building's bylaws. After the judicial officer visited the joint building and arguments were completed, a judgment was issued, resolving the disputes. The judgment ordered the defendants to carry out a series of actions to restore the status quo, and the defendants were also ordered to pay legal costs.

Our firm's management of the case led to the desired outcome for the joint building's committee. Despite the defendants' complex defense arguments, we succeeded in ensuring the restoration of the common property to its original purpose, while safeguarding the rights of all the residents of the joint building. This case highlights the importance of professional, focused legal representation, which enables effective handling of complex real estate disputes.
