This proceeding concerned a claim by an employee for social benefits owed to her by virtue of her employment relationship. The plaintiff, represented by us, argued that during her employment and upon its termination she was not paid the full rights she was entitled to under law, including wage components, severance pay, and ancillary benefits. The plaintiff further argued that the private individual — the company's owner — and the defendant company should be treated as joint employers.

The employer, in turn, filed a counterclaim, arguing that the plaintiff owed it various sums arising from her conduct during her employment or from the termination of the relationship between the parties.

The proceeding involved substantial factual and legal disputes, including questions of credibility, the scope of the employer's payment obligations, and whether there was a genuine basis for the counterclaim.

After examining the evidence and the parties' arguments, the labor court accepted the plaintiff's position: the main claim was accepted, and the court ruled that her rights had indeed been violated and that she was entitled to the remedies sought, jointly from both the company and its owner. The counterclaim, by contrast, was rejected in its entirety, after the court found that the employer had failed to lay a sufficient evidentiary foundation for its claims.
