Labor Case (LC) (Tel Aviv Regional) 30493-11-15 Gilman v. Musachei Sia Netanya Ltd.
In this ruling, we represented the plaintiff, a former employee in the automotive industry, in a claim concerning the recovery of his financial rights from his period of employment and its termination. The dispute centered on the question of what the employee's true wage structure actually was, whether the employer was entitled to include recovery pay ("dmei havraah") and travel expense reimbursement within his wage, and on his entitlement to compensation for failure to provide a notice of employment terms, defects in his payslips, and payment for overtime.
In the course of the proceeding, the defendant argued that the plaintiff had agreed to a wage that already included the recovery pay and travel components, and even presented a notice-to-employee form that, it claimed, supported its version. However, the labor court examined the evidence and testimony in depth, identified substantial contradictions in the defendant's version, and found that the notice-to-employee form presented was not authentic, did not exist during the relevant period, and had never been given to the plaintiff.
Following this, the court accepted the plaintiff's argument that the monthly wage agreed upon with him did not include recovery pay and travel expense reimbursement, and that the employer was therefore required to pay these on top of his wage. The court also found that the payslips issued to him did not correctly reflect his terms of employment and wage components, and that the defendant had not kept lawful attendance records and had failed to rebut his claims regarding the scope of his overtime work.
The ruling illustrates rigorous, evidence-based legal work, including identifying evidentiary failures in the employer's documents, effective cross-examination of the defendant's witnesses, and presenting a factual and legal foundation that led to the claim being largely accepted. The final outcome was an order for the defendant to pay the plaintiff NIS 38,339 for overtime, compensation for defective payslips, compensation for failure to provide a notice to employee, recovery pay and travel expense reimbursement, as well as NIS 10,000 in legal costs.
